The Assembly of the International Maritime Organization (IMO), during its 33rd session from 27 November to 6 December 2023 (‘A 33’), is expected to adopt the Guidelines under the Harmonized System of Survey and Certification (HSSC), 2023 (the ‘HSSC Survey Guidelines, 2023’), based on amendments to the HSSC Survey Guidelines, 2021, contained in IMO Assembly resolution A.1156(32), as well as to adopt the amended versions of the Guidelines on places of refuge for ships in need of assistance (‘revised Guidelines on places of refuge for ships in need of assistance’), of the Non-exhaustive list of obligations under instruments relevant to the IMO Instruments Implementation Code (‘2023 Non-exhaustive list of obligations under instruments relevant to the III Code’) and of the Guidelines on implementation of the International Safety Management (ISM) Code by Administrations (‘2023 Guidelines on implementation of the ISM Code by Administrations’).

(19) It is important to ensure that the provisions of this Regulation do not lead to the safety of crew or oil tankers in search of a safe haven or a place of refuge being endangered.

Nationals of the Occupying Power who, before the outbreak of hostilities, have sought refuge in the territory of the occupied State, shall not be arrested, prosecuted, convicted or deported from the occupied territory, except for offences committed after the outbreak of hostilities, or for offences under common law committed before the outbreak of hostilities which, according to the law of the occupied State, would have justified extradition in time of peace. —(1) Subject to any prescribed exceptions, the manager of a mine shall not permit vehicles (not being vehicles moved by hand) to run in any length of road in the mine unless refuge holes are provided in prescribed positions in the road, beyond seventy-five feet of a working face served by it.

—(1) Where the Minister considers that a particular species, or particular species, of fauna should be specially protected on any land which is, or is contiguous to, a habitat of the species, then, subject to subsection (5) of this section, he may publish in the Iris Oifigiúil and in at least one newspaper circulating in the locality in which the land is situate a notice of his intention to make an order (in this Act referred to as a designation order) designating the land as a refuge for such fauna.

( b ) any other land drainage scheme, in respect of an area which includes land to which an establishment order, a recognition order or a designation order applies, or land to which an agreement made under section 18 of this Act applies, the Commissioners shall, before commencing the scheme, consult the Minister to ascertain if and to what extent the proposed scheme if carried out would affect or interfere with the suitability of the land affected by the scheme for a nature reserve or refuge, as may be appropriate, and take all practicable steps including, where appropriate, the limitation of the drainage scheme to minimise or avoid such effect or interference. (5) Where any premises or accommodation are reserved for the use of persons in a particular category of persons for a religious purpose or as a refuge, nursing home, retirement home, home for persons with a disability or hostel for homeless persons or for a similar purpose, a refusal to dispose of the premises or provide the accommodation to a person who is not in that category does not, for that reason alone, constitute discrimination.

While maintaining the safety level, the definition of sea areas in which ships of Class C and D may operate should be simplified by removing the criterion of ‘where the shipwrecked persons can land’ and by removing the ‘distance to the place of refuge’ for the purpose of defining the sea areas.

In a lift designed following the implementation of the requirements of the harmonised standards there would, as a result of the higher protection area, be enough free space or refuge to crouch in order to ensure safety of persons using the lift.

With respect to the free space or refuge referred to in the essential requirements, the German authority has concluded that the protection against crushing in the M33v3 lift is achieved exclusively by the mechanically protected shelter, which has the dimensions 0,5 m × 0,7 m × 1 m (height × width × length).

The essential requirements were set out in section 2.2 of Annex I to Directive 95/16/EC, which provided that the lift was to be designed and constructed to prevent the risk of crushing when the car is in one of its extreme positions and that that objective was to be achieved by means of free space or refuge beyond the extreme positions.

With respect to the time it takes for a person to assume a safe position, according to the national measure, the risk of crushing caused by insufficient time to adopt a safe position appears when the vertical distance is 0,5 m. However, as explained in recital 32, the free space or refuge in the M33v3 lift would have a vertical distance of 0,5 m only in the case that the brake fails.

As explained by Liftinstituut in its letter, if the brake fails, there is a risk of crushing in both lifts, as the probability that the refuge space could avoid an accident is very small irrespective of the time it takes to assume a certain position on the car roof.
