Where the alien has not lodged a request during the 90-day stay in any 180-day period, his or her stay may be extended pursuant to a bilateral agreement concluded by a Contracting Party and his or her stay beyond the 90-day stay in any 180-day period preceding that extension may be presumed lawful by the competent authorities of that Contracting Party, provided that that alien presents credible evidence which proves that during that time he or she stayed only on the territory of that Contracting Party.

Member States should provide that creditors to which a stay of individual enforcement actions applies, and whose claims came into existence prior to the stay and have not been paid by a debtor, are not allowed to withhold performance of, terminate, accelerate or, in any other way, modify essential executory contracts during the stay period, provided that the debtor complies with its obligations under such contracts which fall due during the stay.

In order to fulfil their obligation under the Schengen Convention, international carriers should verify whether third-country nationals who are required to hold a short-stay visa, a long-stay visa or a residence permit are in possession of a valid short-stay visa, long-stay visa or residence permit by sending a query to the VIS.

Regulation (EC) No 767/2008 established the Visa Information System (VIS) for the exchange of data between Member States on applications for short-stay visas, long-stay visas and residence permits, and on the decision taken to annul, revoke or extend the short-stay visas, long-stay visas and residence permits.

Article 45c(1) and (2) of Regulation (EC) No 767/2008 requires air carriers, sea carriers and international carriers transporting groups overland by coach to use the carrier gateway to verify whether third-country nationals subject to a short-stay visa, airport transit visa or who are required to hold a long-stay visa or a residence permit are in possession of a valid short-stay visa, an airport transit visa, a long-stay visa or a residence permit.

5. 5. If the reimbursement of such costs has not been requested directly from the institution of the place of stay, the costs incurred shall be reimbursed to the person concerned by the competent institution in accordance with the reimbursement rates administered by the institution of the place of stay or the amounts which would have been subject to reimbursement to the institution of the place of stay, if Article 62 of the implementing Regulation had applied in the case concerned.
