Ghabh éifeacht le clásal éagtha ionstraim SURE an 1 Eanáir 2023.
The sunset clause of the SURE instrument took effect on 1 January 2023.

The Commission assessed that these occurrences no longer existed, thus the sunset clause came into effect.

The SURE Regulation contained a ‘sunset clause’ specifying that the Instrument would end on 31 December 2022, unless the Council decided to extend it, on a proposal from the Commission.

The sunset clause applied as of 1 January 2023, meaning that no further financial assistance can be granted to Member States.

Recalls the two events that marked 2021, namely that it was the first year following the sunset clause for the eleventh EDF (31 December 2020), meaning that in 2021 there were no further global commitments of projects under the eleventh EDF, and, in addition, in 2021, the financial implementation for the tenth and eleventh EDF contracts (individual commitments: EUR 2118 million) and payments (EUR 3393 million) was impacted by the prolonged COVID-19 crisis;

Observes that the EDF represents 46,1 % of the portfolio of DG INTPA in terms of payments in 2021, which amounted to EUR 3435 million (i.e. 91,27 % of the annual target); notes that European Investment Bank (EIB) payments amounted to EUR 613 million; observes that, since the sunset clause of the eleventh EDF elapsed on 31 December 2020, there were no new commitments in 2021, with the exception of commitments of the funds stemming from reflows under the ACP Investment Facility from operations under the ninth, tenth and eleventh EDFs; notes that EIB payments concerning the ACP Investment Facility amounted to EUR 179 million;

The sunset clause for the availability of financial support under the SURE instrument specified that it would end on 31 December 2022 unless the Council, on a proposal by the Commission, decided to extend it on the basis that the exceptional occurrences that necessitated SURE (i.e. the severe economic disturbance caused by the COVID-19 pandemic) continued to exist.

Notes the closure of the eighth EDF and the Commission’s intention to close the ninth EDF as soon as possible; notes, in addition, that the closure of the ninth EDF cannot be completed before 2023, taking into account the fact that 19 decisions and 37 contracts are still ongoing, out of which three decisions concern South Sudan and were decided after the sunset clause of the ninth EDF came into effect, with contractual dates lasting until 2023; calls on the Commission to keep the discharge authority informed in a timely manner about the achievement of its intention; notes that the Commission has accepted the recommendation of the Court of Auditors (the ‘Court’) in that regard and that each year it will report the progress made on the closure of the ninth EDF in the annual activity report;
