Mar sin féin, i gcás ina bhfuil aeriompróir faoi réir toirmeasc ar a n-oibriú laistigh den Aontas agus ina liostaítear é in Iarscríbhinn A nó B a ghabhann le Rialachán (CE) Uimh. 474/2006, agus i gcás ina gceadaítear dó aerárthaí léasa fhliuch a oibriú, ar aerárthaí de chuid aeriompróra é nach gcuireann bearta sriantacha den sórt sin bac ar a gcuid oibríochtaí agus nach bhfuil faoi réir toirmeasc ar a n-oibriú den sórt sin, ní bheidh feidhm ag an gceathrú fomhír den mhír seo maidir le sliotáin an iompróra sin, ar choinníoll go gcomhlíonfar na rialacha sábháilteachta is infheidhme san Aontas.”.
However, where an air carrier is subject to an operating ban within the Union and is listed in Annex A or B to Regulation (EC) No 474/2006, and is permitted to operate wet-leased aircraft of an air carrier whose operations are not impeded by such restrictive measures and which is not subject to such an operating ban, the fourth subparagraph of this paragraph shall not apply to that carrier’s slots, provided that safety rules applicable in the Union are complied with.’.
