    —The Land Commission may purchase any untenanted land which they consider necessary for the purpose of providing parcels of land for any of the persons or bodies to whom advances may be made under the provisions of this Act, for such price, payable in 4½ per cent.     —(1) Notwithstanding the provisions of sub-section (4) of section 9 of the Purchase of Land, (Ireland) Act, 1891, and of clause (a)of sub-section (2) of section 24 of the Land Act, 1923 , tenanted land, constituting or forming part of a holding purchased under any Land Purchase Act passed prior to the Land Act, 1923 , shall not, when the tenancy was in existence before the first day of September, nineteen hundred and twenty-two, be excluded from the provisions of the Land Act, 1923 , by reason only of its having been so purchased and the provisions of section 20 of the Land Act, 1923 , shall apply to such tenanted land, unless excluded by some other provision of that Act, from the gale day next preceding the passing of this Act as from which day the liability of the tenant for payment in lieu of rent and of the Land Commission for payment of the sum equivalent to the sum to be collected as payment in lieu of rent, pursuant to section 20 of the Land Act, 1923 , shall commence, but this section shall not alter or affect the liability of the tenant for rent and arrears of rent up to and including such gale day as aforesaid provided that this section shall not apply (a) to tenanted lands, where by reason of the extent and character of the lands the Land Commission are of opinion that the provisions of the Land Act, 1923 , should not apply, or, (b) to tenanted lands vested in the Land Commission under any Act prior to the Land Act, 1923 , so long as the fee-simple thereof remains vested in the Land Commission.

    —(1) Sub-section (4) of section 24 of the Land Act, 1923 , is hereby repealed and in lieu thereof it is hereby enacted that when the Land Commission declare that any land (in this section referred to as the declared land) coming within clause (a) of sub-section (2) of the said section 24 is required for the purpose of relieving congestion, and the tenant or proprietor of the declared land or the wife or the husband of such tenant or proprietor resides on or in the immediate neighbourhood of the declared land and uses it in the same manner as an ordinary farmer in accordance with the proper methods of husbandry, then, if such tenant or proprietor is not the owner of land (other than the declared land) the market value of which exceeds the sum of £2,000, the Land Commission shall, if within the prescribed time and in the prescribed manner such tenant or proprietor requires them to declare and acquire his entire land and to provide him with a new holding, provide such tenant or proprietor with a new holding which the Lay Commissioners consider to be suitable for such tenant or proprietor and also consider (subject to a right of appeal to the Appeal Tribunal, whose decision shall be final) to be of not less market value than the declared land or of not less market value than £2,000 (whichever shall be the lesser sum).

    —(1) At any time within six weeks after the rent, terms, conditions, and compensation in respect of any land proposed to be compulsorily acquired by a local authority under this Act have been fixed by the Irish Land Commission, such local authority, if of opinion that such land cannot be let for allotments at such rents as will secure them from loss, may by notice in writing to all persons interested in the land to which the notice relates or in the rent or compensation fixed as aforesaid in respect of such land, withdraw the scheme comprising such land either wholly or in so far only as relates to such land.

    —(1) Any person claiming to be entitled to an estate or interest in or incumbrance on or claim against any land not registered in the Land Registry which is a puisne claim against such land or would become a puisne claim against such land if a priority charge were created on such land, may (whether the instrument, if any, under which such claim arises is or is not registered in the Registry of Deeds) lodge under section 61 of the Act of 1891 a caution against the registration against such land on or after the first registration thereof of any dealing with such land in favour of the Corporation to the prejudice of such claim.

    (3) Where the Land Commission confers and defines a right of way or a right of access, whether under this section or under any other provision of the Land Purchase Acts, the Land Commission shall have power to enter on the land over which such right of way or access is so conferred and there to repair or construct a road or pass and erect fences and gates and for those purposes to take all or any necessary materials from or out of such land and to provide for the compensation paid by the Land Commission for such right of way or right of access being repaid to the Land Commission by the person for whose benefit such right was conferred.

    (2) Where the circumstances of any land are such that if such land were acquired by the Land Commission the tenant or proprietor of such land would be entitled under this Act to require the Land Commission to provide him with a new holding, the Land Commission shall, notwithstanding anything contained in this section or in any other enactment, not acquire such land compulsorily for any purpose other than the relief of congestion or the provision of sports fields, parks, pleasure-grounds, or play-grounds, for the inhabitants of villages, towns, or cities or for schools or the provision of gardens for schools.

    —The Minister for Finance shall, in the accounts kept by him of transactions in respect of the Land Bond Fund, distinguish between transactions in respect, on the one hand, of land bonds issued under any Act passed before this Act and advances and payments made by the issue of such land bonds and, on the other hand, of land bonds created and issued under this Act and advances and payments made by the issue of such land bonds, and the said Minister shall further distinguish in the said accounts between transactions in respect of each series of land bonds created and issued under this Act and advances and payments made by the issue of land bonds of each such series.

    —(1) Where on the date of the passing of this Act any land is held by a board of health for the purposes of the Principal Acts or after the said date any land is acquired by a board of health for the said purposes and such land is a holding under the Land Purchase Acts or is vested in the Irish Land Commission under the said Acts, such board of health shall with all convenient speed take such steps as may be requisite to have such land vested in such board in fee simple freed and discharged from all liability for any purchase annuity or other payment to the Irish Land Commission.
