Is é an seasamh atá le glacadh thar ceann an Aontais sa Choiste Speisialaithe um Fhorfheidhmiú an Dlí agus um Chomhar Breithiúnach de bhun Airteagal 540(3) CTC, aontú le síneadh go dtí an 30 Meitheamh 2022 a chur leis an tréimhse ar lena linn a fhéadfaidh na Ballstáit leanúint de shonraí pearsanta a mhalartú, faoi mar a thagraítear dó sin in Airteagail 530, 531 agus 534 CTC, agus sonraí pearsanta breise atá ar fáil a sholáthar, faoi mar a thagraítear dó sin in Airteagal 536 CTC, leis an Ríocht Aontaithe.

Sonraítear in Airteagal 552(10) de TCA go bhfuil feidhm ag Airteagal 552(11) de TCA mar gheall ar na himthosca speisialta a chuireann bac ar an Ríocht Aontaithe na coigeartuithe teicniúla is gá a dhéanamh chun na córais phróiseála PNR a d’oibrigh an Ríocht Aontaithe fad a bhí feidhm ag dlí an Aontais maidir léi, a iompú ina gcórais lena bhféadfaí sonraí PNR a scriosadh i gcomhréir le hAirteagal 552(4) de TCA.

Article 552(10) of the TCA states that Article 552(11) of the TCA applies due to the special circumstances that prevent the United Kingdom from making the technical adjustments necessary to transform the PNR processing systems which the United Kingdom operated whilst Union law applied to it into systems which would enable PNR data to be deleted in accordance with Article 552(4) of the TCA.

Council Decision (EU) 2021/2293 of 20 December 2021 on the position to be taken on behalf of the Union in the Partnership Council established by the Trade and Cooperation Agreement with the United Kingdom regarding the extension of the derogation from the obligation to delete passenger name record data of passengers after their departure from the United Kingdom

  4. #1997814

Déantar foráil le hAirteagal 552(13) de TCA i gcás ina mbeidh na himthosca speisialta dá dtagraítear in Airteagal 552(10) de TCA fós ann, go bhfuil an Chomhairle Comhpháirtíochta le síneadh bliana a chur leis an tréimhse eatramhach dá dtagraítear in Airteagal 552(11) de TCA.

Article 552(13) of the TCA provides that where the special circumstances referred to in Article 552(10) of the TCA persist, the Partnership Council is to extend the interim period referred to in Article 552(11) of the TCA for 1 year.

  5. #1997824

Dá bhrí sin, meastar go bhfuil na himthosca speisialta dá dtagraítear in Airteagal 552(10) de TCA fós ann agus de bhun Airteagal 552(13) de TCA, ba cheart don Chomhairle Comhpháirtíochta síneadh bliana a chur leis an tréimhse eatramhach dá dtagraítear in Airteagal 552(11) de TCA, go dtí an 31 Nollaig 2022.

It is therefore considered that the special circumstances referred to in Article 552(10) of the TCA persist, and that, pursuant to Article 552(13) of the TCA, the Partnership Council should extend the interim period referred to in Article 552(11) of the TCA by 1 year, until 31 December 2022.
