(2) Subsection (1) of this section shall be construed as effecting a change of name only and shall not prejudice the existence of the poor rate nor the effect of any reference to it in any statutory or other enactment, but, for the purposes of conforming to such change of name, for every reference to the poor rate in any resolution, notice, rate book or other document passed or used by the council of a county in the making, levying, collecting or recovery of rates, there shall be substituted, in the case of the county rate, a reference to that rate, and every form used for the purpose of the making, levying, collecting or recovery of poor rate shall, in its application in respect of the county rate be amended accordingly.

—Section 6 of the Principal Act and also (unless and until otherwise provided by rules made under that section as extended by this section) all rules made under that section and in force immediately before the commencement of this Act shall, notwithstanding anything to the contrary contained in sub-section (3) of the said section 6, apply to poor-rate and other rates made by a local authority for the service of the local financial year ending on the 31st day of March, 1927 or the service of the local financial year ending on the 31st day of March, 1928 as well as to poor-rate and other rates mentioned in the said sub-section (3).

(5) The council shall divide the agricultural grant amongst all the agricultural lands in the county (exclusive of any urban district therein) in proportion to the rateable value of such agricultural lands assessable to the poor rate, and shall allow the amount assigned on such division to any agricultural land by way of abatement from the amount of the poor rate made in respect of such land or the hereditament or tenement of which such agricultural land forms part.

(2) For the purpose of the preparation of the draft jurors list every such secretary, town clerk, and clerk shall cause a house to house or other sufficient inquiry to be made by the poor rate collectors in his county, borough, or district and it shall be the duty of every such poor rate collector to make such inquiry and also to make such other inquiries for and to give such assistance in the preparation of the draft jurors list as shall be required of him by such secretary, town clerk, or clerk.

(2) The sums payable to county registrars, secretaries town clerks, and clerks and to poor rate collectors under this section shall be paid, in the case of a county and of every borough and urban district in such county, by the council of such county out of the poor rate as a county-at-large charge and, in the case of a county borough, by the council of such county borough out of the rate or fund out of which the general expenses of such council are paid or out of any other rate or fund which the Minister for Local Government and Public Health may, on the application of the Council approve.

—(1) Where untenanted land has or shall hereafter become vested in the Land Commission on the appointed day under the Land Act, 1923 , and such untenanted land was or is then rated in conjunction with other land to poor rate or any other rate, all poor rate and other rate made or assessed in respect of all such land for the local financial year current on the appointed day shall be apportioned between such untenanted land and such other land.

(3) It shall be lawful for the Clare Council to release each of the occupiers of the lands described in the Second Schedule hereto from all poor rate due or accruing due to the said Council by such occupier in respect of his portion of the said lands at the date of the conveyance thereof to the said Council, and for that purpose it shall be lawful for the said Council to make all requisite apportionments of poor rate where portion only of a rated holding is included in the said lands.

(7) Where, in pursuance of sub-section (1) of this section tax has been charged for any year of assessment on any tenement or rateable hereditament with reference to an annual value of such tenement or hereditament computed in accordance with the said sub-section and the valuation of such tenement or hereditament in force in such year of assessment for the purposes of poor rate is subsequently reduced, and such reduction becomes operative for the purposes of poor rate not more than three years after the end of such year of assessment, the Revenue Commissioners, if they are of opinion that relief in respect of the said tax so charged for such year of assessment should be granted with reference to an annual value computed at five-fourths of the said valuation as so reduced, may grant such relief by repayment or otherwise.
