5.—If, in any proceedings under this Act in respect of any breach of any of the Scheduled Conventions or of Protocol I or Protocol II, a question arises under Article 2 or 3 of any of the Scheduled Conventions or Article 1 or 3 of Protocol I or Article 1 of Protocol II (which relate to the circumstances in which the Conventions and Protocols apply), that question shall be determined by the Minister and a certificate purporting to set out any such determination and to be signed by or on behalf of the Minister shall be received in evidence and be deemed to be so signed, without further proof, unless the contrary is shown.".

Acts described as grave breaches in the Conventions are grave breaches of this Protocol if committed against persons in the power of an adverse Party protected by Articles 44, 45 and 73 of this Protocol, or against the wounded, sick and shipwrecked of the adverse Party who are protected by this Protocol, or against those medical or religious personnel, medical units or medical transports which are under the control of the adverse Party and are protected by this Protocol.

This Protocol, which develops and supplements Article 3 common to the Geneva Conventions of 12 August 1949 without modifying its existing conditions of application, shall apply to all armed conflicts which are not covered by Article 1 of the Protocol Additional to the Geneva Conventions of 12 August 1949, and relating to the Protection of Victims of International Armed Conflicts (Protocol I) and which take place in the territory of a High Contracting Party between its armed forces and dissident armed forces or other organised armed groups which, under responsible command, exercise such control over a part of its territory as to enable them to carry out sustained and concerted military operations and to implement this Protocol.
Ar mhaithe le soiléireacht agus chun síniú agus teacht i bhfeidhm tapa prótacail a éascú, is iomchuí Prótacal nua maidir le hiompar tráthrialta idirnáisiúnta agus iompar tráthrialta speisialta paisinéirí de chóiste agus de bhus (an “Prótacal nua”) a ullmhú chun na leasuithe arna gcomhaontú a léiriú agus a thagann in ionad an Phrótacail a bhí ar oscailt lena shíniú go dtí an 16 Aibreán 2019.
For reasons of clarity and in order to facilitate the rapid signature and entry into force of a protocol, it is appropriate to prepare a new Protocol on the international regular and special regular carriage of passengers by coach and bus (the ‘new Protocol’) to reflect the amendments agreed and replace the Protocol which was open for signature until 16 April 2019.

Article 13(1) of the Protocol provides that notwithstanding any other provisions of the Protocol, any reference to the customs territory of the Union in the applicable provisions of the Protocol or in the provisions of Union law made applicable to and in the United Kingdom in respect of Northern Ireland by the Protocol shall be read as including the land territory of Northern Ireland.

Notwithstanding any other provisions of this Protocol, any reference to the territory defined in Article 4 of Regulation (EU) No 952/2013 in the applicable provisions of the Withdrawal Agreement and of this Protocol, as well as in the provisions of Union law made applicable to and in the United Kingdom in respect of Northern Ireland by this Protocol, shall be read as including the part of the territory of the United Kingdom to which Regulation (EU) No 952/2013 applies by virtue of Article 5(3) of this Protocol.

In accordance with Article 7, paragraph 5.e, of the Protocol, Member States shall designate a single competent authority to receive the notification under Article 7, paragraph 5.a, of the Protocol, and perform the actions described in Article 7, paragraphs 5.b, 5.c and 5.d, of the Protocol, and shall, when the notification to the Secretary General of the Council of Europe under Article 7, paragraph 5.a, of the Protocol is first given, communicate to the Secretary General of the Council of Europe the contact information of that authority.
