—(1) The Commissioner shall on his own motion at every quinquennial revision cause to be made in respect of every railway undertaking a revision of the valuation of every railway hereditament in Saorstát Eireann forming part of such undertaking in accordance with the provisions of this Act and every valuation so made in relation to a railway undertaking is referred to in this Act as a valuation of such railway undertaking as a whole.

It should therefore be provided that where the licensing authority, on the basis of the check carried out during the period between 1 March 2020 and 31 August 2020, finds that a railway undertaking can no longer meet the requirements relating to financial fitness, it should be able to, before 31 August 2020, decide not to suspend or revoke the licence of the railway undertaking concerned, provided that safety is not at risk and provided that there is a realistic prospect of a satisfactory financial reconstruction of the railway undertaking within the following six months.

Notwithstanding Article 24(1) of Directive 2012/34/EU, where a licensing authority, based on a check referred to in that provision, carried out during the period between 1 March 2020 and 31 August 2020, finds that a railway undertaking can no longer meet the requirements relating to financial fitness referred to in Article 20 of that Directive, it may, before 31 August 2020 decide not to suspend or revoke the licence of the railway undertaking concerned, provided that safety is not at risk and provided that there is a realistic prospect of a satisfactory financial reconstruction of the railway undertaking within the following six months.

(4) The Railways (Valuation for Rating) Act, 1931 (No. 47 of 1931), shall apply to the Company in respect of its railway undertaking in like manner as it applied immediately before the establishment date to the dissolved railway company in respect of its railway undertaking, and accordingly references in the Schedule to that Act to the dissolved railway company shall, on and after the establishment date, be construed as references to the Company.

Where the infrastructure manager, in its legal form, organisation or decision-making functions, is not independent of any railway undertaking, the functions referred to in Sections 2 and 3 of Chapter IV shall be performed respectively by a charging body and by an allocation body that are independent in their legal form, organisation and decision-making from any railway undertaking.

However, this Regulation should not lead to a railway undertaking being bound by more favourable contractual conditions offered by a tour operator or ticket vendor, unless an arrangement between the railway undertaking and the tour operator or the ticket vendor provides otherwise.

For journeys including one or more connections, a ticket or tickets, purchased in a single commercial transaction from a railway undertaking, shall constitute a through-ticket and the railway undertaking shall be liable in accordance with Articles 18, 19 and 20 if the passenger misses one or more connections.

Without prejudice to paragraph 2, the railway undertaking may allow the passenger, at his or her request, to conclude contracts with other providers of transport services which enable the passenger to reach the final destination under comparable conditions, in which case the railway undertaking shall reimburse the passenger for the costs that he or she incurs.

on departure from, transit through or arrival at a staffed railway station, the station manager or the railway undertaking shall provide assistance free of charge in such a way that that person is able to board the train, to transfer to a connecting rail service for which he or she has a ticket, or to alight from the train, provided there is trained staff on duty. Where the need for assistance has been notified in advance in accordance with point (a) of Article 24, the station manager or the railway undertaking shall ensure that assistance is provided as requested;

If the language chosen by the railway undertaking for the Rule Book is not the language in which the appropriate information was originally supplied, it is the responsibility of the railway undertaking to arrange for any necessary translation and/or provide explanatory notes in another language.’;

It shall supply the terms in regular use in the language chosen by the railway undertaking and in the ‘operating’ language of the infrastructure manager(s) whose infrastructure the railway undertaking operates on, based on the terminology used by the respective infrastructure manager.’;

The infrastructure manager shall ensure that the information provided to the railway undertaking(s) is complete and accurate, and shall inform the railway undertaking of the changes on the line characteristics through RINF whenever such information becomes available and affects trains operation.’;

Competent authorities may take measures to increase competition between railway undertakings by limiting the number of contracts that they award to one railway undertaking.

The competent authority shall periodically assess whether the railway undertaking has achieved its targets for meeting the performance requirements as set in the contract and shall make its findings public.

To this end, the competent authorities may, before launching the competitive tendering procedure, decide to limit the number of contracts to be awarded to the same railway undertaking.’;

1.-These rules shall be observed at every quinquennial revision where the net annual value of a railway company's undertaking as a whole for the purposes of such revision exceeds the minimum value of such undertaking as a whole for the purposes of such revision, and references in these rules to the net annual value of a railway undertaking as a whole, the minimum valuation of a non-running line hereditament, and the minimum valuation of a running line hereditament shall be construed as referring, respectively, to the net annual value of such railway undertaking as a whole for the purposes of such revision, the minimum valuation of such non-running-line hereditament for the purposes of such revision, and the minimum valuation of such running line hereditament for the purposes of such revision.
