In view of the nature of such temporary detention and the impact that it might have on the freedom of movement and the right to property, the period of detention should be limited to the absolute minimum time that other competent authorities require to determine whether there are grounds for further intervention, such as investigations or seizure of the cash based on other legal instruments.

(71) The obligation to prioritise the production of certain products respects the essence of and does not disproportionately affect the freedom to conduct a business and the freedom of contract laid down in Article 16 of the Charter of Fundamental Rights of the European Union (the ‘Charter’) and the right to property laid down in Article 17 of the Charter.

The protection of geographical indications needs to be balanced against the protection of trade marks with a reputation and of well-known marks, in particular in light of the fundamental right to property as set out in Article 17 of the Charter, as well as the obligations resulting from international law.

As recently recalled by the Court of Justice, the right to information plays a role in upholding the right to an effective remedy and, ultimately, guarantees the effective exercise of the fundamental right to property under Article 17 of the Charter, which includes IP rights.
