In fisheries under a regional fisheries management organisation (‘RFMO’) or a Sustainable Fisheries Partnership Agreement (‘SFPA’), if a Union fishing vessel does not comply with the conditions for a fishing authorisation and the Member State fails to take appropriate action to remedy the situation, even after having been required to do so by the Commission, the Commission should conclude that no appropriate action has been taken.
