Whenever the Minister has reason to believe, whether by means of a report from an inspector or otherwise, that infected potatoes or potatoes suspected to be so infected are to be found on any land or in any place, he may serve on any person to whom these Regulations apply a notice (in these Regulations referred to as a ring rot prevention notice).

(1) If, on the expiration of fourteen days after the service, under these Regulations, on a person of a ring rot prevention notice such person has not complied with the terms of the notice, an inspector may enter on the land or into the place specified in the notice and may do wll such things as may be necessary to comply with the notice.

The Regulations implement the provisions of Council Directive 80/665/EEC on the control of potato ring rot, which is designed to prevent the occurrence of this disease and in the event of such occurrence, to introduce control measures aimed at eradicating it and preventing its spread.

(3) An officer who is suspended under this section shall rot receive any remuneration from the local authority during the continuance of his suspension, and at the termination of his suspension the remuneration which he would have received during the period of suspension if he had not been suspended shall be wholly or partly forfeited, or paid to him, or otherwise disposed of, as the Minister shall direct.

Where the Revenue Commissioners are satisfied that any books chargeable with this duty are imported for the use of a library which is rot a proprietary library conducted mainly for profit, the Revenue Commissioners may, subject to compliance with such conditions as they may think fit to impose, permit such books to be imported without payment of this duty.

(3) Where relief is given by virtue of this section to an individual and any loan made or money advanced to him or to a person connected with him is, in accordance with the provisions of paragraph (c) of subsection (5), and by virtue of subparagraph (ii), (iii), (iv) or (v) of subsection (5) (c), subsequently regarded as not having been made or advanced in the ordinary course of a business, any relief so given, which would rot have been given if, at the time the relief was given, the loan or money advanced had been so regarded, shall be withdrawn and there shall be made all such assessments or additional assessments as are necessary to give effect to the provisions of this subsection.

As regards the crushed bulky waste used in the period from February 2009 to December 2009, the Walloon Region states that it had all the necessary technical characteristics, since it has a low density (0,6 tonnes/m3 after compacting), is non-biodegradable and rot-proof (preventing subsidence and presenting no risk of causing waste degradation reactions), is permeable (allowing the passage of water and gases) and could be supplied and crushed in sufficient quantities.

The Walloon Region explains in its observations of 3 May 2021 that, since suitable waste (in terms of density, non-biodegradability, resistance to rot and permeability) was available in sufficient quantities for the restoration of the landfill during the entire period (mainly fluff and crushed bulky waste), the Walloon Region did not have to address the question of which raw materials to use as an alternative to waste.

The Region claims that, given their technical characteristics, lava rocks (pozzolana) comply with the specific requirements for the restoration of the landfill (in particular their low density, non-biodegradability, resistance to rot and permeability) and could have been an alternative to the use of fluff if that had not been available in sufficient quantities.

Consequently, in accordance with Article 18 of the basic Regulation, the findings in relation to the likelihood of continuation of dumping were based on the facts available, in particular information in the request for review and statistical data from Eurostat, Global Trade Atlas (‘GTA’), the USITC DataWeb database, the Comisión Federal de Electricidad, the Comisión Reguladora de Energía, the Instituto Nacional de Estadística y Geografía, the website of Rot Química and publicly available information from the official website of the Mexican company CYDSA.

If any potatoes are delivered or placed on rail or loaded or moved in contravention of these Regulations, or of a notice (including a ring rot prevention notice) or direction served thereunder, the Minister or an inspector may seize such potatoes and any packages in which they are or have been contained and may dispose of them or cause them to be disposed of in such manner as the Minister or the inspector may think fit, or may remove them or cause them to be removed to such place and in such manner as the Minister or the inspector may think fit, and may serve a notice on the consignee of, or on the person in charge of, or in possession of, any of the aforesaid potatoes or packages, directing the person on whom the notice is served to dispose of such potatoes or packages within such time and in such manner as may be specified in the notice, or to remove such potatoes or packages within such time and to such place as may be specified in the notice.
