5. "Arrest warrant" shall mean a judicial decision issued by a State with a view to the arrest and surrender by another State of a requested person, for the purposes of conducting a criminal prosecution or executing a custodial sentence or detention order.

The following offences, if they are punishable in the issuing State by a custodial sentence or a detention order for a maximum period of at least three years and as they are defined by the law of the issuing State, shall, under the terms of this Agreement and without verification of the double criminality of the act, give rise to surrender pursuant to an arrest warrant:

If two or more States have issued a European arrest warrant or an arrest warrant for the same person, the decision as to which of the arrest warrants shall be executed shall be taken by the executing judicial authority with due consideration of all the circumstances and especially the relative seriousness and place of the offences, the respective dates of the arrest warrants and whether the warrant has been issued for the purposes of prosecution or for execution of a custodial sentence or detention order.

Norway and Iceland, on the one hand, and the European Union, on behalf of any of its Member States, on the other hand, may notify each other that, for relations of States with other States to which the same notification applies, consent is presumed to have been given for the prosecution, sentencing or detention with a view to the carrying out of a custodial sentence or detention order for an offence committed prior to his or her surrender, other than that for which he or she was surrendered, unless in a particular case the executing judicial authority states otherwise in its decision on surrender.

This action should apply in cases where, based on a clear indication, a person is suspected of intending to commit or of committing any of the offences referred to in Article 2(1) and (2) of Framework Decision 2002/584/JHA, where further information is needed to execute a custodial sentence or detention order against a person convicted of any of the offences referred to in Article 2(1) and (2) of Framework Decision 2002/584/JHA, or where there is a reason to believe that he or she will commit any of those offences.

Má tá barántas gabhála Eorpach nó barántas gabhála eisithe ag dhá Stát nó níos mó i leith an duine chéanna, is é an t-údarás breithiúnach forghníomhaitheach a ghlacfaidh an cinneadh maidir le cé acu de na barántais sin a bheidh le forghníomhú agus tabharfaidh sé aird chuí ar na himthosca go léir agus go háirithe ar thromchúis choibhneasta agus ar an áit inar rinneadh na gcionta, ar dhátaí an bharántais gabhála nó an bharántais gabhála Eorpaigh faoi seach, agus cibé acu ar eisíodh iad chun críoch ionchúisimh nó chun pianbhreith choimeádta nó ordú coinneála a fhorghníomhú, agus chun oibleagáidí dlíthiúla Ballstát a fhorghníomhú a dhíorthaítear ó dhlí an Aontais i ndáil le, go háirithe, na prionsabail maidir le saoirse gluaiseachta agus le neamh-idirdhealú ar fhorais náisiúntachta.
If two or more States have issued a European arrest warrant or an arrest warrant for the same person, the decision as to which of those arrest warrants is to be executed shall be taken by the executing judicial authority, with due consideration of all the circumstances, especially the relative seriousness of the offences and place of the offences, the respective dates of the arrest warrants or European arrest warrants and whether they have been issued for the purposes of prosecution or for the execution of a custodial sentence or detention order, and of legal obligations of Member States deriving from Union law regarding, in particular, the principles of freedom of movement and non-discrimination on grounds of nationality.
Déanfaidh an Stát eisiúna gach tréimhse coinneála a eascraíonn ó fhorghníomhú an bharántais gabhála a asbhaint ón tréimhse iomlán coinneála atá le seirbheáil sa Stát eisiúna de bharr na pianbhreithe coimeádta nó an t-ordú coinneála a bheith tugtha.
The issuing State shall deduct all periods of detention arising from the execution of an arrest warrant from the total period of detention to be served in the issuing State as a result of a custodial sentence or detention order being passed.
