    “(5) Má theipeann ar úinéir nó ar áititheoir na talún nó an fhoirgnimh sin, laistigh de na seacht lá réamhráite, a thoiliú a thabhairt de réir an fho-ailt sin roimhe seo, féadfaidh an Bord nó an gnóthaire údaraithe, le toiliú an Bhoird ach ní ar aon slí eile, an líne sin a chur trasna na talún sin nó an daingneán sin a cheangal den fhoirgneamh sin san ionad agus sa tslí atá luaite san fhógra sin, faoi réir teideal a bheith ag an úinéir nó ag an áititheoir sin go n-íocfar cúiteamh leis i leith an Bord nó an gnóthaire údaraithe d'fheidhmiú na gcumhachtaí a thugtar leis an bhfo-alt seo agus d'fheidhmiú na gcumhachtaí a thugtar le fo-alt (9) den alt seo, agus measúnófar an cúiteamh sin, d'éagmais comhaontú, faoi fhorálacha an Acquisition of Land (Assessment of Compensation) Act, 1919, agus measfar, chun na críche sin, gur údarás poiblí an Bord.”.

    "(5) If the owner or occupier of such land or building fails within the seven days aforesaid to give his consent in accordance with the foregoing subsection, the Board or the authorised undertaker with the consent of the Board but not otherwise may place such line across such land or attach such fixture to such building in the position and manner stated in the said notice, subject to the entitlement of such owner or occupier to be paid compensation in respect of the exercise by the Board or authorised undertaker of the powers conferred by this subsection and of the powers conferred by subsection (9) of this section, such compensation to be assessed in default of agreement under the provisions of the Acquisition of Land (Assessment of Compensation) Act, 1919, the Board for this purpose being deemed to be a public authority.".

    —Más rud é, ar éileamh arna dhéanamh chuig an údarás pleanála, go suífear gur tharla, de dheasca gníomh a rinne an t-údarás sin de bhun alt 85 den Phríomh-Acht trí aon chábla, sreang nó píblíne a shuíomh, a athnuachan nó a dhíchur, trí aon bhrac nó daingneán a dhaingniú nó trí aon fhógra a ghreamú, gur laghdaíodh luach aon leasa a bhí ag aon duine sa talamh nó sa déanmhas an tráth a rinne an t-údarás pleanála an gníomh, nó gur bhain damáiste d'aon duine a raibh leas aige sa talamh nó sa déanmhas an tráth sin trí shealúchas na talún nó an déanmhais sin aige a dhíshocrú, beidh an duine sin i dteideal, faoi réir fhorálacha an Achta seo, go n-íocfaidh an t-údarás pleanála leis, mar chúiteamh, méid an laghdaithe luacha sin nó méid an damáiste.

    —If, on a claim made to the planning authority, it is shown that, as a result of the action of such authority pursuant to section 85 of the Principal Act in placing, renewing or removing any cable, wire or pipeline, attaching any bracket or fixture or affixing any notice, the value of an interest of any person in the land or structure existing at the time of the action of the planning authority is reduced, or that any person having an interest in the land or structure at that time has suffered damage by being disturbed in his enjoyment of such land or structure, such person shall, subject to the provisions of this Act, be entitled to be paid by the planning authority by way of compensation the amount of such reduction in value or the amount of the damage.
