Cumulation should be possible not only with OCTs and countries that have concluded an Economic Partnership Agreement with the Union, but under certain conditions also for products originating in countries with which the Union is applying a free trade agreement as well as for products entering the Union duty-free and quota-free under the Union’s General System of Preferences, also subject to conditions.

Protocol 2 to the Agreement between the European Economic Community and the Kingdom of Norway of 14 May 1973 (‘the bilateral Free Trade Agreement between the European Economic Community and the Kingdom of Norway’) and Protocol 3 to the Agreement on the European Economic Area (‘EEA Agreement’) as amended by the Decision of the EEA joint committee No 140/2001 of 23 November 2001 amending Protocols 2 and 3 to the EEA Agreement, concerning processed and other agricultural products, determine the trade arrangements between the Union and the Kingdom of Norway for certain agricultural and processed agricultural products.

The Agreement in the form of an Exchange of Letters between the European Community and the Kingdom of Norway concerning Protocol 2 to the bilateral Free Trade Agreement between the European Economic Community and the Kingdom of Norway (‘the Agreement in the form of an Exchange of Letters’) temporarily suspends the duty free regime applied under Protocol 2 to goods classified under CN codes 22021000 (waters, including mineral waters and aerated waters, containing added sugar or other sweetening matter or flavoured) and ex 2202 90 10 (other non-alcoholic beverages containing sugar) replaced by CN code 22021000, ex22029100 and ex220299.
Dá bhrí sin, maidir leis an bhfionraí sealadach ar an gcóras saor ó dhleacht a chuirtear i bhfeidhm faoi Phrótacal 2 a ghabhann leis an gComhaontú Saorthrádála déthaobhach idir Comhphobal Eacnamaíoch na hEorpa agus Ríocht na hIorua, níor cheart an fionraí sin a chur i bhfeidhm don bhliain 2023.
Therefore, the temporary suspension of the duty-free regime applied under Protocol 2 to the bilateral Free Trade Agreement between the European Economic Community and the Kingdom of Norway should not be applied for the year 2023.
Na rialacha tionscnaimh a leagtar amach i bPrótacal 3 a ghabhann leis an gComhaontú Saorthrádála déthaobhach idir Comhphobal Eacnamaíochta na hEorpa agus Ríocht na hIorua, beidh feidhm acu maidir leis na hearraí a liostaítear in Iarscríbhinn a ghabhann leis an Rialachán seo.
