Is dleathach d'aon chosantóir in aon chaingean chun talamh a aisghabháil mar gheall ar neamhíoc cíosa, sula seachadfar a chosaint nó tráth a seachadta, nó, i gcás nach gceanglófar ar an gcosantóir cosaint a sheachadadh, sula gcomhdófar mionnscríbhinn mar fhreagra ar éileamh an ghearánaí nó tráth a comhdaithe, nó tráth ar bith is déanaí ná sin le cead ón gCúirt, ar fhógra a thabhairt don ghearánaí, suim airgid a íoc isteach sa Chúirt i leith cíosa, maille le gealltanas na costais a bheidh tabhaithe an tráth sin a íoc ar iad a fhómhas agus a fhionnadh, agus, i gcás nach n-íocfar an céanna, go ndéanfar breithiúnas a thaifeadadh ina choinne, agus féadfaidh an gearánaí, air sin, mura nglacfaidh sé leis an tsuim sin mar lán-urscaoileadh ar an gcaingean, le costais arna bhfómhas ag an oifigeach cuí, dul ar aghaidh sa chaingean sin ar a phriacal; agus más rud é, ar an tsaincheist a thriail, go ndealróidh sé gan aon suim níos mó a bheith dlite i leith cíosa tráth seirbheála na toghairme ná an tsuim a bheidh íoctha isteach sa Chúirt, taifeadfar an fíorasc i bhfabhar an chosantóra.
It shall be lawful for any defendant in any action for the recovery of land for non-payment of rent, before or at the time of delivering his defence, or where the defendant is not required to deliver a defence, before or at the time of filing an affidavit in answer to the plaintiff's claim, or at any later time by leave of the Court, upon notice to the plaintiff to pay into Court a sum of money for rent, with an undertaking to pay the costs then incurred when taxed and ascertained and in case of non-payment thereof to suffer judgment to be marked, and thereupon the plaintiff, if he shall not accept the said sum in full discharge of the action, with costs to be taxed by the proper officer, may proceed in the said action at his peril; and if upon trial of the issue it shall appear that no greater sum was due for rent at the time of the service of the summons than the sum paid into Court, the verdict shall be entered for the defendant.
