AMENDMENTS OF ENACTMENTS CONSEQUENT UPON THE SUBSTITUTION IN COUNTY BOROUGHS AND THE BOROUGH OF DUN LAOGRAIRE OF THE MUNICIPAL RATE FOR THE POOR RATE AND CERTAIN OTHER RATES.

(2) The registration expenses shall be paid in the case of the Council of an administrative county out of the Poor Rate as a county at large charge, and in the case of the Council of a county borough out of the rate or fund out of which the general expenses of the Council are paid, or out of any other rate or fund which the Minister for Local Government may on the application of the Council approve.

( b ) Any person holding the office of secretary of a County Council, Town Clerk of a County or other Borough, or Clerk of an Urban District Council may be required to prepare from the information furnished by the collectors of poor rate and otherwise and to furnish to the registration officer draft electors lists, and to attend and furnish such information as may be required at the revision of claims and objections under these rules at such times and places as may be ordered by the registration officer.

Provided that the Minister for Finance may in any case withhold payment of any compensation payable by him until he has received from the Secretary of the Council of the County, County Borough, or Urban District, or Commissioners of the Town in which the injury occurred, a certificate that there is no money due to such Council or Commissioners by the person to whom such compensation is payable; in respect of any poor-rate or other rate levied by such Council or Commissioners.

The amounts required for payment of the instalments of the purchase annuity for lands purchased by a County Borough Council or an Urban Council under this section shall be defrayed out of the poor-rate, and for lands purchased by Town Commissioners under this section out of the town rate.

(3) This section shall only apply to poor-rate and other rates made by a local authority for the service of any of the local financial years ending on the 31st day of March, 1924, the 31st day of March, 1925, or the 31st day of March, 1926, respectively, or for the service of any previous local financial year.

—(1) The expenses of the execution of this Act shall be paid, in the case of an administrative county, by the council of that county out of the poor-rate as a county-at-large charge, and in the case of a county borough, by the council of that county borough out of the rate or fund out of which the general expenses of the council are paid, or out of any other rate or fund which the Minister for Local Government may, on the application of the council, approve.

(4) The sums required to repay the amount of the loan borrowed under this section shall be raised and levied by means of the poor rate off the agricultural land in the county.

(2) The cost of any loan borrowed under this section and the moneys for the repayment thereof and for payment of the interest thereon shall, subject to the provisions of this section, be raised by means of the poor rate as a county-at-large charge, but the county council may resolve that such cost and moneys shall, instead of being levied as a county-at-large charge, be levied as an urban charge or a district charge off any urban or rural district or districts specially benefited by the works in respect of which the loan was raised.

(3) It shall be the duty of the council of any county in which is situate a drainage district or any part of a drainage district to which a charging order made under this Act applies to collect from the proprietors or (where the proprietor is not also the occupier) the occupiers of so much of the lands charged by such order as is situate in such county all sums payable by the proprietors of such lands to such council under the charging order, and any such sum shall and may be collected and recovered in the like manner as poor rate is or may be collected and recovered.

(2) All sums and interest charged on a county fund by any charging order made under this Act shall be paid to the Commissioners by the county council on whose county fund the same is charged, at the times and in the manner declared by the charging order, and shall be paid by such council out of the moneys collected by them from the proprietors or the occupiers of the lands on which the same is charged and, if and so far as such moneys are not sufficient, out of the county fund and shall be raised by means of the poor rate as a county-at-large charge.

—(1) Einne le n-a bhfuil pinsean seirbhíse mileata iníoctha fén Acht so, má bhíonn sé, aon uair le linn an pinsean san do bheith aige, ag fáil aon luach saothair, pinsin, no liúntais is iníoctha amach as airgead puiblí, pe'ca ag an Oireachtas no amach as an bPrímh-Chiste a soláthruíodh é no tríd an ráta dealbhais no tré aon ráta eile a bhuail údarás áitiúil, déanfar an pinsean seirbhíse mileata is iníoctha leis an duine sin fén Acht so do chur ar fionnraí i méid a háireofar do réir na bhforálacha atá sa Triú Sceideal a ghabhann leis an Acht so agus san faid a bheidh sé ag fáil an luach saothair, an phinsin, no an liúntais sin mar adubhradh.
—(1) If any person to whom a military service pension is payable under this Act shall at any time during the continuance of such pension be in receipt of any remuneration, pension, or allowance payable out of public moneys, whether provided by the Oireachtas or out of the Central Fund or by means of the poor rate or any other rate imposed by a local authority, the military service pension payable to such person under this Act shall be suspended to an extent calculated according to the provisions contained in the Third Schedule to this Act while he is in receipt of such remuneration, pension, or allowance as aforesaid.

—(1) All expenses incurred before or after the passing of this Act by the council of a county in the execution of the Principal Act or this Act shall be defrayed out of the poor rate and shall be charged upon the whole area of such county exclusive of the area of any borough, urban district, or town having town commissioners situate in such county.

(3) Every sum to which this section applies and the interest thereon at the rate aforesaid shall be deemed to be charged as from the date on which such sum was borrowed on the poor rate leviable in the county or rural district (as the case may be) of the council by which the same was borrowed.

(3) The expenses of a board of health incurred in the performance of the duties of the county council as sanitary authority for a county health district shall be raised by the county council in such county health district by means of the poor rate.

( a ) in the case of the council of a county, shall be defrayed out of the county funds and raised by means of the poor rate as a county at large charge, and

—(1) All expenses incurred by a county council in the execution of this Act shall be defrayed out of the Poor Rate and shall be charged on the functional area of such council as defined in the preceding section.
(2) I ndeire gach bliana airgeadais áitiúla deimhneoidh an tAire, le hordú fé n-a shéala, cadé an tsuim a chaith sé, as airgead a soláthruíodh fé fho-alt (1) den alt so, i rith na bliana airgeadais áitiúla san ag cur có-líona a dhualgaisí fén Acht so in éifeacht, agus cáinmheasfa sé an tsuim sin ar na contaethe agus ar na contae-bhuirgí uile agus fé leith i Saorstát Éireann do réir luach bliantúil glan na maoine is ionrátuithe i gcóir ráta dhealbhais sna contaethe agus sna contae-bhuirgí sin fé seach agus cuirfe sé cóipeanna den ordú san chun comhairle gach contae agus contae-bhuirge den tsórt san.
(2) At the end of every local financial year the Minister, by order under his seal, shall certify the sum which has been expended by him out of moneys provided under sub-section (1) of this section during such local financial year in carrying the performance of his duties under this Act into effect, and shall assess that sum on the several counties and county boroughs in Saorstát Eireann in proportion to the net annual value of the property rateable for poor rate in such counties and county boroughs respectively and shall send copies of such order to the council of every such county and county borough.

(3) The council of every county and county borough shall raise the amount assessed by such order on such county or county borough by means of the poor rate as a county at large charge and shall pay the same into the Exchequer of Saorstát Eireann in accordance with such directions as may be given for the purpose by the Minister for Finance.

—(1) All moneys which a county council is by this Act authorised or directed to pay out of the county fund and also all expenses incurred by a county council in the execution of this Act and the raising of which is not otherwise provided for by this Act shall be raised by means of the poor-rate as a county-at-large charge.
(3) Is tríd an ráta dealbhais mar mhuirear ar an gcontae iomlán a cruinneofar costas aon iasachta a gheobhfar fén alt so agus an t-airgead chun í d'aisíoc agus chun an t-ús uirthi d'íoc.
(3) The cost of any loan borrowed under this section and the moneys for the re-payment thereof and for the payment of the interest thereon shall be raised by means of the poor-rate as a county-at-large charge.

—If, in the opinion of the Minister for Local Government and Public Health a county council has failed to make adequate provision by means of the poor rate for defraying the expenses to be incurred by them in the local financial year ending on the 31st day of March, 1926, such county council shall, if the said Minister so directs, apply any portion of the supplementary grant that becomes payable to such county council in the financial year beginning on the 1st day of April, 1925, for the purpose of defraying current expenses or in such other manner as the said Minister shall think advisable and in such case the provisions of section 3 of this Act shall not apply.

15.— All moneys which the county council is by this Act authorised or directed to pay out of the county fund and all expenses incurred by the said council in the execution of this Act and the raising of which is not otherwise provided for by this Act shall be raised by means of the poor-rate as a county-at-large charge.
(3) Le hordú fé n-a shéala leagfidh an tAire Rialtais Áitiúla agus Sláinte Puiblí an bhreis sin ar na contaethe agus ar na contae-bhuirgí uile agus fé seach i Saorstát Éireann mar ráta do réir luach bliantúil glan na maoine is ionrátuithe i gcóir ráta dhealbhais sna contaethe agus sna contae-bhuirgí sin fé seach agus cuirfe sé cóip den ordú san chun comhairle gach contae agus contae-bhuirge acu.
(3) The Minister for Local Government and Public Health shall by order under his seal assess the said excess on the several counties and county boroughs in Saorstát Eireann rateably in proportion to the net annual value of the property rateable for poor rate in such counties and county boroughs respectively and shall send to the council of every such county and county borough a copy of such order.
(4) Cruinneoidh comhairle gach contae agus contae-bhuirge tríd an ráta dealbhais mar mhuirear ar an gcontae iomlán an cion den bhreis sin a leagfar ar a gcontae no ar a gcontae-bhuirg leis an ordú san agus ar bheith cruinnithe dho íocfid an cion san isteach sa Stát-Chiste ar pé slí a ordóidh an tAire Airgid.
(4) The council of every county and county borough shall raise by means of the poor rate as a county-at-large charge the proportion of the said excess assessed on their county or county borough by such order and shall pay such proportion when raised into the Exchequer in such manner as the Minister for Finance shall direct.
(2) Na costaisí a bhainfidh leis an mbord sláinte do cheanntar shláinte chontae d'fheidhmiú no do chólíona aon chomhachta no dualgais fén alt so no fé alt 10 den Phríomh-Acht cruinneoidh an chomhairle chontae sa cheanntar san tríd an ráta dealbhais iad agus, fé réir na bhforálacha de sna Public Health (Ireland) Acts, 1878 to 1919, a bhaineann le cruinniú costaisí speisialta tuath-údaráis sláintíochta agus fé réir na bhforálacha d'aon achtachán le n-a n-orduítear aon chostaisí do chruinniú mar a cruinnítear costaisí speisialta den tsórt san, is go cothrom o iomlán an cheanntair sin a cruinneofar iad.
(2) The expenses of the exercise or performance of any power or duty under this section or under section 10 of the Principal Act by the board of health for a county health district shall be raised by the county council in such district by means of the poor rate and shall, subject to the provisions of the Public Health (Ireland) Acts, 1878 to 1919, in regard to the raising of special expenses of a rural sanitary authority and to the provisions of any enactment which directs any expenses to be raised as such special expenses are raised, be raised equally over the whole of such district.
(3) Na costaisí a bhainfidh le bord sláinte i gcó-cheanntar d'fheidhmiú agus do chólíona aon chomhachtanna agus dualgaisí fén alt so is go cothrom o iomlán an chó-cheanntair sin, tríd an ráta dealbhais, a cruinneofar iad.
(3) The expenses of the exercise and performance by a board of health in a joint district of any powers and duties under this section shall be raised equally over the whole of such joint district by means of the poor rate.
(3) An caithteachas fé n-a raghaidh comhairle chontae fén alt so chun aon chúrsa uisce, dréin, bancánacht no obair eile do ghlana no do choinneáil suas, íocfar é, sa chéad dul síos, amach as ciste na contae agus cruinneofar é tríd an ráta dealbhais mar mhuirear ar an gcontae iomlán.
(3) The expenditure incurred by a county council under this section in the cleansing or maintenance of any Watercourse, drain, embankment or other work shall be defrayed in the first instance out of the county fund and shall be raised by means of the poor rate as a county-at-large charge.
