Cuirfidh sí an t-oibreoir eacnamaíoch lena mbaineann ar an eolas, ag tús na seiceála agus na cigireachta ar an láthair ar a dhéanaí, faoin nós imeachta is infheidhme maidir leis an tseiceáil agus leis an gcigireacht ar an láthair, lena n-áirítear na coimircí nós imeachta is infheidhme, agus dualgas an oibreora eacnamaíoch comhoibriú.
It shall, at the latest at the start of the on-the-spot check and inspection, inform the economic operator concerned of the procedure applicable to the on-the-spot check and inspection, including the applicable procedural safeguards, and the economic operator's duty to cooperate.

The European Anti-Fraud Office (OLAF) shall, where appropriate, carry out on-the-spot checks and inspections of economic operators concerned directly or indirectly by such funding in accordance with the procedures laid down in Council Regulation (Euratom, EC) No 2185/96 of 11 November 1996 concerning on-the-spot checks and inspections carried out by the Commission in order to protect the European Communities’ financial interests against fraud and other irregularities [10], with a view to establishing whether there has been fraud, corruption or any other illegal activity affecting the financial interests of the Union in connection with a grant agreement, grant decision or contract funded pursuant to this Regulation.

OLAF may carry out investigations, including on-the-spot checks and inspections, in accordance with the provisions and procedures laid down in Regulation (EC) No 1073/1999 and Council Regulation (Euratom, EC) No 2185/96 of 11 November 1996 concerning on-the-spot checks and inspections carried out by the Commission in order to protect the European Communities’ financial interests against fraud and other irregularities [22] with a view to establishing whether there has been fraud, corruption or any other illegal activity affecting the financial interests of the Union in connection with a grant or a contract funded by the Agency.

Certain on-the-spot checks on specific measures for agriculture in the outermost regions of the Union and the smaller Aegean islands are however performed outside of the integrated administration and control system, the derogations provided for in Chapter II of Implementing Regulation (EU) 2020/532 appeared not be sufficient to address the difficulties encountered in performing the on-the-spot-checks accurately and within the time limit, especially taking into account the geographical remoteness of the outermost regions.

‘Where the Member State has determined a period in accordance with Article 21(1)(d), at least 50 % of the minimum rate of on-the-spot checks provided for in Articles 32, 33 and 35, respectively, shall be spread throughout that period for the respective animal aid scheme or animal-related support measure. However, where no retention period is applied, where the retention period cannot be fixed in advance or where the retention period starts before an aid application or payment claim has been submitted, all on-the-spot checks referred to in Articles 32, 33 and 35 shall be spread over the period in which an animal may qualify for the payment or support.’;

Commission Implementing Regulation (EU) No 809/2014 lays down rules on, inter alia, the timing of the on-the-spot checks, the control rates of certain on-the-spot checks within the integrated system, including for animal aid schemes, and the increase of the control rate as regards certain schemes.
