In fisheries under a regional fisheries management organisation (‘RFMO’) or a Sustainable Fisheries Partnership Agreement (‘SFPA’), if a Union fishing vessel does not comply with the conditions for a fishing authorisation and the Member State fails to take appropriate action to remedy the situation, even after having been required to do so by the Commission, the Commission should conclude that no appropriate action has been taken.

Therefore, the Sustainable Fisheries Partnership Agreement and the implementing Protocol thereto between the European Union and the Republic of Madagascar enters into force on 12 December 2023 pursuant to Article 17(1) of the Agreement and Article 18(1) of the Protocol.

In accordance with Council Decision (EU) 2023/1476, the Sustainable Fisheries Partnership Agreement between the European Union and the Republic of Madagascar (‘Madagascar’) (the ‘Agreement’) and its implementing protocol (the ‘Protocol’) were signed on 30 June 2023.
