- Comment "There were formerly five committee procedures available under the Decision on Committee Procedure [ IATE:786020 ]. Following the entry into force of the Treaty of Lisbon [ IATE:2242386 ], that Decision was repealed and replaced by the Regulation on Committee Procedure.The advisory procedure [ IATE:914346 ] (Article 3 of the Decision) remains (Article 4 of the Regulation), as does the regulatory procedure with scrutiny [ IATE:2229352 ] (Article 5a of the Decision) with regard to existing basic acts making reference thereto (Article 12 of the Regulation), but the- management procedure [ IATE:914347 ] (Article 4)- regulatory procedure [ IATE:914348 ] (Article 5) and- safeguard procedure [ IATE:914349 ] (Article 6)have been abolished.In their place, the Regulation introduces:- the 'examination procedure' (Article 5)- a variant of the 'examination procedure' allowing immediate adoption of acts by the Commission in exceptional urgent cases to avoid disruption of agricultural markets or a risk for the EU's financial interests (Article 7) and- an unnamed procedure (a variant of either the advisory procedure or the examination procedure) to be used for the adoption of provisional anti-dumping or countervailing measures and in other duly justified urgent cases (Article 8).The examination procedure ensures that implementing acts cannot be adopted by the Commission if they are not in accordance with the opinion of the committee, except in very exceptional circumstances, where they may apply for a limited period. It also ensures that the Commission is able to review the draft implementing acts where no opinion is delivered by the committee, taking into account the views expressed within the committee.The examination procedure applies in particular for the adoption of:(a) implementing acts of general scope;(b) other implementing acts relating to:(i) programmes with substantial implications;(ii) the common agricultural and common fisheries policies;(iii) the environment, s"

Le nouveau règlement arrête deux procédures pour contrôler l'exercice des compétences d'exécution de la Commission: une procédure consultative [IATE:914346 ] et une procédure d'examen. Ces deux procédures font intervenir des comités composés de représentants des États membres et présidés par la Commission.
