Comment Under Article 289 of the Treaty on the Functioning of the European Union (TFEU), consultation is a special legislative procedure. In the cases laid down by the Treaty, the Council must consult the European Parliament before voting on the Commission proposal and take its views into account. However, it is not bound by the Parliament's position but only by the obligation to consult it. This procedure is now applicable in a limited number of legislative areas, such as internal market exemptions and competition law. In addition, this consultation procedure is used for the adoption of non-mandatory instruments, especially recommendations and opinions issued by the Council and the Commission.
