- Comment Le droit de propriété est un droit fondamental classique dans une société démocratique et libérale. Il est inscrit dans toutes les constitutions nationales, et a été consacré par la jurisprudence de la Cour de justice. Le paragraphe 1er de l'article 17 énonce les conditions de réglementation de ce droit, également applicables à la propriété intellectuelle. (paragraphe 2).
