(2) Más rud é, ar iarratas fén bhfo-alt san roimhe seo den alt so do bheith fé bhráid na hArd-Chúirte, gur deimhin leis an gCúirt sin, tar éis na fianaise sin do bhéarfaidh an t-iarratasóir no an tArd-Aighne ar áird d'éisteacht, an mhaoin le n-a mbainfidh an t-iarratas san do bheith, nuair a tháinig sí i gcoimeád no i seilbh chorpardha an Aire no baill den Ghárda Síochána no baill de sna Fórsaí Cosanta (do réir mar a bheidh), ina maoin dhleathaigh leis an iarratasóir no le duine tré n-a mbeidh no fé n-a mbeidh an t-iarratasóir ag éileamh agus nach de thoradh ná i gcúrsa gníomhachta ba dhochar do shíocháin no d'ordú no do shábháltacht an Stáit do fuair an t-iarratasóir no an duine eile sin adubhradh í agus ná raibh sí á húsáid ná le húsáid (ag an iarratasóir ná ag duine ar bith eile) chun aon ghníomhacht den tsórt san do chur ar aghaidh agus, i gcás an mhaoin sin do thabhairt thar n-ais don iarratasóir no cúiteamh alos an chéanna d'íoc leis, ná déanfaidh an t-iarratasóir, ná ná déanfar le n-a thoiliú, an mhaoin ná an cúiteamh san d'úsáid chun aon ghníomhacht den tsórt san adubhradh do chur ar aghaidh, féadfaidh an Ard-Chúirt a ordú (fé mar is gá sa chás) an mhaoin sin do thabhairt thar n-ais don iarratasóir no an tAire Airgeadais d'íoc cúitimh leis an iarratasóir i gcailliúint na maoine sin.
(2) Where on an application under the foregoing sub-section of this section, the High Court, after hearing such evidence as may be adduced by the applicant or by the Attorney-General, is satisfied that when the property to which such application relates came into the custody or the physical possession of the Minister or of a member of the Gárda Síochána or of a member of the Defence Forces (as the case may be), it was the lawful property of the applicant or of a person through or under whom the applicant claims and was not acquired by the applicant or other person aforesaid as a result or in the course of an activity prejudicial to the peace, order, or security of the State and was not being or intended to be used (whether by the applicant or any other person) in furtherance of any such activity and that, if such property is returned or compensation in respect thereof is paid to the applicant, such property or compensation will not be used by the applicant or with his consent in furtherance of any such activity as aforesaid, the High Court may direct either (as the circumstances shall require) that such property be returned to the applicant or that compensation for the loss thereof be paid to the applicant by the Minister for Finance.
