An EFTA State may request the Agency to initiate an arbitration procedure according to Title III, Chapter 4 of Directive 2001/83/EC of the European Parliament and of the Council.

Níor cheart go mbeadh feidhm ag an Rialachán seo maidir le haon chaingean nó aon imeachtaí coimhdeacha a bhaineann, go háirithe, le binse eadrána a chur ar bun, le cumhachtaí eadránaithe, le nós imeachta eadrána a sheoladh nó le haon ghné eile de nós imeachta den sórt sin, ná a bhaineann le haon chaingean nó aon bhreithiúnas a bhaineann le dámhachtain eadrána a neamhniú, a athbhreithniú, a achomharc, a aithint nó a fhorghníomhú.
This Regulation should not apply to any action or ancillary proceedings relating to, in particular, the establishment of an arbitral tribunal, the powers of arbitrators, the conduct of an arbitration procedure or any other aspects of such a procedure, nor to any action or judgment concerning the annulment, review, appeal, recognition or enforcement of an arbitral award.

In cases of disagreement between the Agency and national safety authorities on the issuing of single safety certificates or vehicle authorisations, an arbitration procedure should be established so that decisions are taken in a concerted and cooperative manner.

If the Party against which remedial measures were taken does not submit a request pursuant to paragraph 9 of this Article within the time period laid down in that paragraph, that Party may initiate the arbitration procedure referred to in Article 739 to challenge a remedial measure on the grounds set out in paragraph 9 of this Article without having prior recourse to consultations in accordance with Article 738.

if no mutually acceptable solution is found, the concerned Party may adopt rebalancing measures no sooner than five days from the conclusion of the consultations, unless the notified Party requests within the same five day period, in accordance with Article 739(2), the establishment of an arbitration tribunal by means of a written request delivered to the other Party in order for the arbitration tribunal to decide whether the notified rebalancing measures are consistent with paragraph 2 of this Article;

Bearing in mind the two pillar system of the EEA Agreement and with regard to the transfer of power to the European Union Agency for Railways to issue vehicle authorisations and single safety certificates, and approve European Rail Traffic Management System trackside equipment projects, for applicants in the EFTA States, as well as the arbitration procedure provided for in disputes between national safety authorities of the EFTA States and the European Union Agency for Railways, the Contracting Parties recognise that this solution does not create a precedence for future adaptations of EU acts to be incorporated into the EEA Agreement.
