- Comment eine Einrichtung gilt als wesentlich, wenn es aufgrund von physischen, geografischen, rechtlichen oder wirtschaftlichen Gegebenheiten unmöglich oder äußerst schwierig ist, sie ein zweites Mal aufzubauen. Ein Beispiel dafür wäre ein nationales Stromnetz, das von verschiedenen Elektrizitätserzeugern benutzt wird, um die Endverbraucher zu erreichen: Da es für diese Erzeuger unwirtschaftlich wäre, ein eigenes Verteilungsnetz aufzubauen, sind sie vom Zugang zur bestehenden Infrastruktur abhängig. Die Verweigerung des Zugangs zu einer wesentlichen Einrichtung kann als Missbrauch einer beherrschenden Stellung durch das Unternehmen, das die Einrichtung kontrolliert, betrachtet werden, insbesondere wenn dies den Wettbewerb auf einem nachgelagerten Markt verhindert

- Comment A facility is essential if its duplication is impossible or extremely difficult due to physical, geographical, legal or economic constraints. Take for example a national electricity power grid used by various electricity producers to reach the final consumers: Since it would not be viable for these producers to build their own distribution network, they depend on access to the existing infrastructure. Denying access to an essential facility may be considered an abuse of a dominant position [IATE:1899551 ] by the entity controlling it, in particular where it prevents competition in a downstream market [IATE:1899635 ].

- Definition Installation ou infrastructure nécessaire pour atteindre les clients et/ou pour permettre aux concurrents d'exercer leurs activités. Une facilité est essentielle lorsque sa reproduction est impossible ou extrêmement difficile en raison de contraintes physiques, géographiques, juridiques ou économiques. Prenons l'exemple d'un réseau électrique national utilisé par les différents producteurs d'électricité pour approvisionner les consommateurs finals: dans la mesure où il ne serait pas viable pour ces producteurs de construire leur propre réseau de distribution, ils dépendent de l'accès à l'infrastructure existante. Le fait de refuser l'accès à une facilité essentielle peut être considéré comme un abus de position dominante de la part de l'entité contrôlant cette facilité, notamment lorsque cela empêche toute concurrence sur un marché situé en aval (cf. marché en aval).
