    Comment Seit dem Eheschließungsrechtsgesetz vom 04.05.1998 kennt das deutsche Recht keine trennenden Ehehindernisse mehr, deren Nichtbeachtung zur Unwirksamkeit der Ehe führen. Die nunmehr einzige Sanktion bei Nichtbeachtung eines Ehehindernisses ist die Aufhebbarkeit mit Wirkung für die Zukunft. / Depuis l'entrée en vigueur de la loi du 04.05.1998 réformant le régime de la contractation du mariage, le droit allemand ne connaît plus d'empêchement dirimant à mariage dont l'inobservation a pour conséquence que le mariage contracté ne produit aucun effet. La seule sanction en cas d'inobservation d'un empêchement à mariage est désormais que le mariage peut être resilié avec effet pour l'avenir.
