Comment The FLEGT Action Plan has led to two key pieces of legislation:- Council Regulation (EC) No 2173/2005, allowing for the control of the entry of timber to the EU from countries entering into bilateral FLEGT Voluntary Partnership Agreements (VPA) with the EU;- Regulation (EU) No 995/2010, as an overarching measure to prohibit placing of illegal timber and timber products on the internal market.

Comment NB: according to information received in September 2018 from a Commission expert, the adjective 'voluntary' refers to 'partnership' and not to 'agreement'. Once agreed, the FLEGT voluntary partnership agreements include commitments and action from both parties to halt trade in illegal timber, notably with a licensing scheme at the partner country and the issuance of FLEGT licences that certify the legality of timber exported to the EU. While parties enter into a VPA voluntarily, the agreement becomes legally binding when both parties have ratified it.
