Irish legal system The Law Reform Commission recommended in a report in 2010 that the terminology of family law be changed to replace ‘guardianship’ with ‘parental responsibility’, ‘custody’ with ‘day-to-day care’ and ‘access’ with ‘contact’ in order to more accurately reflect what these concepts mean and to be closer to the terminology used in EU legislation. The law has not changed yet and in The Children and Family Relationships Bill, a draft piece of legislation that should change the law in this area the terms “guardianship”, “custody” and “access” have been retained because these are used in a Constitutional amendment on this subject but the definitions are those proposed in the Law Reform Commission report.
