- Comment Under s. 9 of the Children Act 1997, certain other persons in addition to a parent or Guardian of a child may now apply to the court to be afforded access to a child. These persons include the relative of a child such as a grandparent or a person who has acted in loco parentis in respect of the relevant child. - Comment "Under the Children Act 1989 Section 9, a grandparent has no right as such to apply for a residence or contact order in respect of a child. A grandparent may be a person with whom the child has lived for a period of at least three years or a person who has the consent of the persons who have parental responsibilty, in which case, on those grounds, the grandparent is entitled to apply for a residence or contact order. If not, a grandparent must obtain the leave of the court to make such an application. The test for granting leave, in Section 10(9), does not differ for grandparents or any other relative (or other applicant). There are proposals to change the law.
