    Comment Gemäß der Richtlinie über den Schutz der finanziellen Interessen der Union haben die Mitgliedstaaten die erforderlichen Maßnahmen zu treffen, um das Sicherstellen von „Tatwerkzeugen“ und „Einnahmen aus Straftaten“, die aus den in Artikel 3 (Betrug zum Nachteil der finanziellen Interessen der Union), Artikel 4 (Bestechlichkeit, Bestechung and missbräuchliche Verwendung) und Artikel 5 (Anstiftung, Beihilfe, Versuch) genannten Straftaten stammen, zu ermöglichen. For Member States bound by the Directive 2014/42/EU of 3 April 2014 on the freezing and confiscation of instrumentalities and proceeds of crime in the EU, they should do it in accordance to the PIF Directive, Article 10.

    Comment In accordance to the 'PIF Directive', Member States must take the necessary measures to enable the freezing of 'instrumentalities' and 'proceeds of crimes' from the offences included in Articles 3 ('Fraud affecting the Union's financial interests'), 4 ('passive corruption', 'active corruption' and 'misappropriation') and 5 ('incitement', 'aiding', 'abetting', 'attempt')). For Member States bound by the Directive 2014/42/EU of 3 April 2014 on the freezing and confiscation of instrumentalities and proceeds of crime in the EU, they should do it in accordance to the PIF Directive, Article 10.
