- Comment The European Commission has proposed introducing functional separation as a new remedy, particularly for legacy fixed line networks being upgraded to next-generation access networks. The Commission sees functional separation as necessary to ensure fair competition in markets dominated by one operator. Functional separation should provide both new market entrants and the incumbent’s retail service provider equal terms for network access, giving the new entrants a fair chance to build their businesses using the incumbent's existing infrastructure. The Commission proposes to apply functional separation only in exceptional cases, where there has been persistent failure to achieve effective non-discrimination and where there is little or no prospect of network-based competition in the near future.
