Definition A set of rules governing the division and ownership of marital property. Can be established by law or agreement between the spouses. Reference COUNCIL-EN
Comment NB: The concept of matrimonial property regimes in the civil law sense (or the equivalent for civil partnerships) does not clearly exist in England and Wales and Northern Ireland. The general law of property applies to the couple's property during the marriage, and on divorce or dissolution the courts have wide distributive discretion when considering ancillary relief.REF:Council-EN, based on 'Response to public consultation on the European Commission proposed Regulations on matrimonial property regimes and the property consequences of registered partnerships', UK Ministry of Justice, 28 November 2011 https://consult.justice.gov.uk/digital-communications/matrimonial_property [16.7.2013]The proposal for a Regulation on jurisdiction, applicable law and the recognition and enforcement of decisions in matters of matrimonial property regimes defines "matrimonial property regime" as a "set of rules concerning the property relationships of spouses, between the spouses and in respect of third parties". For more information on what this covers, see the proposal for a Regulation (COM(2011) 126 final) CELEX:52011PC0126/EN .
