- Nóta The return by a State, in any manner whatsoever, of an individual to the territory of another State in which he or she may be persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion; or would run the risk of torture.Refoulement includes any action having the effect of returning the individual to a State, including expulsion, deportation, extradition, rejection at the frontier, extra-territorial interception and physical return.

- Nóta Il convient de signaler que ce terme n'est pas clairement défini et qu'il est difficile à distinguer du refus d'entrée ou des mesures d'éloignement. .La notion se rapproche de refus d'entrée (fiche IATE:3583894 ) mais inclut en outre un «éloignement» de la personne. .Le terme «refoulement » est souvent présent dans la jurisprudence UE dans le contexte du «principe de non-refoulement» IATE:3584077 (fait d’éloigner un réfugié vers un pays où sa vie ou sa liberté serait menacée)
