    Comment There is no such criminal offence in the UK, and in civil law the concept is indistinguishable from a failure to provide maintenance to a dependant. This concept should be distinguished from the fact of a parent not living in the same household as a child, which means that that parent is the non-resident parent for the Child Support Act 1991, and from desertion, which is a ground of divorce. It is not a requirement of desertion in UK divorce law that one spouse leaves the matrimonial home.
