- Comment Le statut de prisonnier de guerre, qui est défini de façon exhaustive par la troisième Convention de Genève pour les conflits armés internationaux (article 4), est lié au statut de combattant. Toutefois, le Protocole I aux conventions de Genève (1977) élargit cette notion et permet à toute personne arrêtée dans le cadre d’un conflit après avoir directement participé aux hostilités de bénéficier (au moins à titre conservatoire) de ce statut.
