    Comment Le juge d'instruction continue de jouer un rôle important dans les systèmes belges et français. Il existe aussi en Espagne, au Portugal, aux Pays-Bas, en Slovénie et en Grèce, mais n'a pas les mêmes attributions dans chacun de ces pays.En Espagne par exemple, le juge d'instruction mène l'instruction sous le contrôle du ministère public, mais jouit en pratique d'une grande indépendance.Au Portugal, l'instruction est menée par le ministère public. Le juge d'instruction intervient uniquement si la personne mise en examen ou la victime demandent son intervention afin de déterminer s'il existe suffisament de motifs pour une mise en accusation.Dans d'autres pays, le juge d'instruction tend à disparaitre (comme en Allemagne ou en Italie où il a été supprimé) au profit d'un juge de l'instruction ou de l'enquête.Dans les pays européens où le juge d'instruction a été supprimé, la phase préparatoire de la procédure pénale a été confiée au ministère public et le contrôle des libertés publiques et de la légalité à un juge du siège.
