- Comment NB: In the Return Directive, the term 'illegally staying third-country national' refers only to people who do not have a right to enter or be in the EU, while the term from the TFEU 'person residing without authorisation' [ IATE:929322 ], which is used in readmission agreements between the EU and non-EU countries, is broader because it not only includes 'illegally staying third-country nationals' a country may wish to return, but also own nationals or stateless persons a country has to readmit to its territory.
