Definition period of time after which debtors may be fully discharged from their debts Reference "Council-EN, based on Directive (EU) 2019/1023 on preventive restructuring frameworks, on discharge of debt and disqualifications, and on measures to increase the efficiency of procedures concerning restructuring, insolvency and discharge of debt (Directive on restructuring and insolvency)"
Comment In UK insolvency law, the 'discharge period' refers to the length of time before the end of the bankruptcy period ('discharge from bankruptcy'), which involves not only a release from debts, but also the lifting of bankruptcy restrictions (e.g. disqualification). The EU Directive on restructuring and insolvency, however, has a separate term for each of these aspects of insolvency:- the 'discharge period', referring to the length of time before an entrepreneur is fully discharged (released) from their debts and- the 'disqualification period', referring to the lifting of restrictions on an entrepreneur taking up or pursuing a trade, business, craft or profession on grounds of insolvency.
