- Definition die zuständigen Behörde, die nach nationalem Recht für eine oder mehrere der folgenden Aufgaben verantwortlich ist: a) im Hoheitsgebiet der Mitgliedstaaten zu prüfen, ob die Voraussetzungen für die Einreise in das oder den Aufenthalt im Hoheitsgebiet der Mitgliedstaaten erfüllt sind, b) die Voraussetzungen für den Aufenthalt von Drittstaatsangehörigen im Hoheitsgebiet der Mitgliedstaaten zu prüfen und diesbezügliche Entscheidungen zu treffen, soweit es sich bei dieser Behörde nicht um eine „Asylbehörde“ im Sinne des Artikels 2 Buchstabe f der Richtlinie 2013/32/EU des Europäischen Parlaments und des Rates handelt, und gegebenenfalls im Einklang mit der Verordnung (EG) Nr. 377/2004 des Rates Beratung zu leisten, c) die Rückkehr von Drittstaatsangehörigen in ein Herkunfts- oder Transitdrittland vorzunehmen; Reference "Verordnung (EU) 2017/2226 des Europäischen Parlaments und des Rates vom 30.
