Definition set of instructions given or wishes made by a capable adult concerning issues that may arise in the event of their incapacity (i.e. when they are not in a position to protect their own interests) Reference "COM-EN, based on: Commission Staff Working Document Impact Assessment Report accompanying the documents Proposal for a Regulation on jurisdiction, applicable law, recognition and enforcement of measures and cooperation in matters relating to the protection of adults and Proposal for a Council decision authorising Member States to become or remain parties, in the interest of the European Union, to the Convention on the International Protection of Adults, SWD(2023) 155 final, Glossary."
Comment "Advance directives can be made on the following matters: health, welfare, everyday life, other personal matters, economic and financial matters, and the selection of a natural or legal person ‘as a representative to be taken into account by the authorities taking a measure directed to the protection of the adult’.These directives may be addressed to the world at large, without necessarily identifying who should carry them out, or be addressed to (a) specific person(s). Advance directives may or may not be included in powers of representation. The European Law Institute is currently working on a project on advance directives, however they also refer to them as ‘advance choices (for future disablement)’."
