Definition share in a deceased person's estate which is reserved for certain persons by law Reference Council-EN
Comment "NB: The 'reserved shares' collectively make up the 'non-disposable part of the estate' (see IATE:1129524 ).Under French law, the 'réserve héréditaire' is reserved for certain persons to guarantee that they cannot be disinherited by a will ('forced heirship') or lifetime gifts ('clawback'), and to ensure that they are provided for in the event of an intestate succession.NB: This system does not exist in the law of England and Wales, which have the Inheritance (Provision for Family and Dependants) Act 1975 (16.2.2021) instead. Scotland has a system of legal rights and legitim (HM Revenue & Customs IHTM12221, Succession: Scottish Prior and Legal rights: Legal rights: Introduction (16.2.2021)).NB: In its comments on the 2009 European Commission proposal for a Regulation on Succession, the Max Planck Institute suggested that the term 'reserved share' did not cover 'indefeasible interests' resulting from a duty of maintenance, and suggested adding it to the relevant articles of the proposal.REF: Council-EN, based on 1989 Hague Convention (16.2.2021) and Max Planck Institute Comments on the proposal for a Regulation on Succession (16.2.2021).See also:- IATE:3537945 - forced heirship- IATE:3508447 - clawback- IATE:1253166 - intestate succession"
