- Comment Folgende Einnahmen stellen in den Haushaltsplan der Union einzusetzende Eigenmittel dar: a) traditionelle Eigenmittel in Form von Abschöpfungen, Prämien, Zusatz- oder Ausgleichsbeträgen, zusätzlichen Teilbeträgen und anderen Abgaben, Zöllen des Gemeinsamen Zolltarifs und anderen Zöllen auf den Warenverkehr mit Drittländern, die von den Organen der Union eingeführt worden sind oder noch eingeführt werden, Zöllen auf die unter den ausgelaufenen Vertrag über die Gründung der Europäischen Gemeinschaft für Kohle und Stahl fallenden Erzeugnisse sowie Abgaben, die im Rahmen der gemeinsamen Marktorganisation für Zucker vorgesehen sind; b) (...) Einnahmen, die sich aus der Anwendung eines für alle Mitgliedstaaten einheitlichen Satzes auf die nach Unionsvorschriften bestimmten harmonisierten MwSt.-Eigenmittelbemessungsgrundlagen ergeben. Die für diese Zwecke heranzuziehende Bemessungsgrundlage darf 50 % des in Absatz 7 definierten Bruttonationaleinkommens (BNE) eines jeden Mitgliedstaats nicht überschreiten; c) (...) Einnahmen, die sich aus der Anwendung eines im Rahmen des Haushaltsverfahrens unter Berücksichtigung aller übrigen Einnahmen festzulegenden einheitlichen Satzes auf den Gesamtbetrag der BNE aller Mitgliedstaaten ergeben. (Artikel 2) Die Mittel werden von den Mitgliedstaaten im Einklang mit den nationalen Vorschriften erhoben und der Kommission nach Maßgabe der gemäß Artikel 322 Absatz 2 AEUV erlassenen Verordnungen zur Verfügung gestellt (Artikel 8, Erhebung der Eigenmittel und deren Bereitstellung für die Kommission).

- Comment Revenue that shall constitute own resources in the Union budget: ‘(a) traditional own resources consisting of levies, premiums, additional or compensatory amounts, additional amounts or factors, Common Customs Tariff duties and other duties established or to be established by the institutions of the Union in respect of trade with third countries, customs duties on products under the expired Treaty establishing the European Coal and Steel Community, as well as contributions and other duties provided for within the framework of the common organisation of the markets in sugar; (b) … the application of a uniform rate valid for all Member States to the harmonised VAT assessment bases determined in accordance with Union rules. For each Member State the assessment base to be taken into account for this purpose shall not exceed 50 % of gross national income (GNI)…; (c) … the application of a uniform rate, to be determined pursuant to the budgetary procedure in the light of the total of all other revenue, to the sum of GNI of all the Member States.’ (Article 2). Resources are collected by the Member States in accordance with the national provisions and made available to the Commission, in accordance with regulations adopted under Article 322(2) TFEU (Article 8 Collecting own resources and making them available to the Commission).
