- Comment Auch einzelstaatliche Beamte können einer einzelstaatlichen Disziplinarordnung unterworfen sein. Die zuständigen Behörden können die Disziplinarbefugnis gegen Beamte ausüben. Sanktionen, die keiner strafrechtlichen Sanktion gleichzusetzen sind und die der gleichen Person für das gleiche Verhalten auferlegt werden, können bei der Verurteilung einer Person wegen einer Straftat gemäß der Richtlinie über den Schutz der finanziellen Interessen der Union berücksichtigt werden. In Bezug auf sonstige Sanktionen gilt der Grundsatz „ne bis in idem“. Die Richtlinie über den Schutz der finanziellen Interessen der Union kriminalisiert keine Verhaltensweisen, die keinen disziplinären Disziplinarstrafen oder sonstigen Maßnahmen wegen Verletzung der Amtspflichten unterliegen, wenn sie nicht auf die betroffenen Personen anwendbar sind.

- Comment National officials may also be subject to a national disciplinary regime. Competent authorities may exercise disciplinary powers against public officials. Sanctions that cannot be equated to criminal sanctions, imposed on the same person for the same conduct, can be taken into account when sentencing a person for a criminal offence under the PIF Directive. With regard to other sanctions, the principle of ne bis in idem applies. The PIF Directive does not criminalise behaviours not subject to disciplinary penalties or other measures with regard to breach of official duties, if they can be applied to the persons concerned.
