    Comment Property rights of spouses on divorce or annulment are determined acording to the general law and not according to a determined set of rules. Matrimonial property (matrimonial home plus property acquired during the marriage otherwise than by gift or inheritance) may be distinguished from non-matrimonial property (property the parties bring with them into the marriage or acquire by inheritance or gift during the marriage). There is no ‘full community property’ system in the UK. Such a system is discussed in the report by the Scottish Law Commission (No 86, 1984) quoted at length in Harris-Short and Miles, e.g. ‘In a ‘full community property’ system practically all the property of a married couple, including property owned by one of them before the marriage or inherited during it, would be automatically subject to a special form of joint ownership. It would not belong to one spouse or the other but would become ‘community property’.

    Comment Les époux conviennent que tous leurs biens, de quelque nature qu'ils soient ou d'où qu'ils proviennent, seront communs, y compris les dettes. Les époux n'ont plus aucun bien personnel. Ce régime est fiscalement avantageux, pour le conjoint survivant au moment de la succession, puisqu'il reçoit l'ensemble des biens, avec une clause d'attribution intégrale. Système idéal pour les conjoints sans enfants puisqu'il protège le conjoint survivant d'héritiers malveillants.
