Comment "NB: Article 1(2)(d) of the 1989 Hague Succcession Convention covers all inter vivos dispositions, including gifts.Although common law jurisdictions deal solely in terms of ""testamentary"" and ""non-testamentary"" dispositions, there is a number of so-called ""will substitutes"" or non-testamentary transfers of assets that do constitute what are known in civil law jurisdictions as ""inter vivos"" dispositions. They are:1. inter vivos trusts2. joint bank accounts where the survivor takes the balance3. life insurance and the designation of a beneficiary to take the benefits of the policy on the death of the insured4. pension provision accounts where the designated beneficiary takes the benefit of the account proceeds by way of a joint lives and survivor annuity, in the event of the prior death of the pensioner5. joint tenancy (typically spousal and concerning the matrimonial home) with the right of the survivor to take the whole.Reference: Waters Explanatory Report on the 1989 Hague Convention http://www.hcch.net/upload/expl32e.pdf ]"
