- Comment Use of the term 'minor' to refer to person under 18 years of age is historic. The term 'child' is used throughout the Children Act 1989 and the Children Scotland Act 1995 : Scottish law on minors and pupils is superseded by Age and Legal Capacity Scotland Act 1991.Distinctions now made in various contexts in relation to children are defined by age. For example a girl under the age of 13 cannot consent to sexual intercourse(cf Sexual Offences Act 2003).The Sexual Offences (Scotland ) Act 2009 creates the statutory offence of “rape of a young child”. There are alternatives to criminal prosecution for a child under the age of 16 in Scotland(referral to a Childrens’ Hearing) and for a young person under the age of 18 in England (Youth Offender Panel).Consent by a child under the age of 16 to medical treatment or medical procedures depends on actual competence, maturity and ability to understand. Children under the age of 16 have capacity to enter into contracts provided that the transaction is of a kind commonly entered into by person’s of the child’s age and and the terms of the transaction are not unreasonable.
