- Comment "NB: The New Legislative Framework (which includes Decision No 768/2008/EC) changed the emphasis of EU legislation in relation to market access. Formerly the language of Union harmonisation legislation concentrated on the notion of “placing on the market” which is traditional free movement of goods language, i.e.it focuses on the first making available of a product on the EU market. The NLF puts the emphasis on making a product available thus giving more importance to what happens to after a product is first made available (see IATE:816740 ). Council-EN, based on the European Commissions ‘Blue Guide’ on the implementation of EU product rules, 2014 However, Regulation (EC) No 178/2002, for instance, defines ""placing on the market"" as the holding of food or feed for the purpose of sale, including offering for sale or any other form of transfer, whether free of charge or not, and the sale, distribution, and other forms of transfer themselves. This is more in line with the definition of ""making available on the market"" given in Decision No 768/2008/EC (see IATE:816740 ).
