    Comment Regarding removal of residence, a person who has residence of a child (eg the residential parent) can be deprived of residence if residence is awarded to the non-residential parent by a Section 8 order (Children Act 1989). The making of a care order (on application of local authority) automatically discharges any residence order and passes parental responsibility to local authority.

    Comment "Si le retrait total de l'autorité parentale implique le retrait du droit de garde, l'inverse n'est pas toujours vrai, ce dernier n'étant qu'un attribut de l'autorité parentale: ainsi le tribunal peut prononcer un retrait partiel de l'autorité parentale sans prononcer le retrait du droit de garde. Dans ce dernier cas, l'enfant est considéré soit comme ""enfant en garde"", s'il y a eu seulement retrait du droit de garde (C. action soc. et fam., art. L. 227-1), soit comme ""pupille de l'État"", s'il y a eu retrait total de l'autorité parentale (C. action soc. et fam., art. L. 224-4-5°)."
