- Comment Den früheren oder derzeitigen Ehepartner oder Partner zur Durchführung nicht einverständlicher sexuell bestimmter Handlungen mit einer dritten Person zu veranlassen, gilt ebenfalls als Vergewaltigung in der Ehe. Zustimmung bedeutet das freiwillige Einverständnis als Ergebnis des freien Willens des Betroffenen. Nach dem Übereinkommen des Europarats zur Verhütung und Bekämpfung von Gewalt gegen Frauen und häuslicher Gewalt stellt angesichts der Intimität und des Vertrauens, die mit der Beziehung verbunden sind, die Vergewaltigung eines früheren oder des derzeitigen Partners einen Umstand dar, der bei der Festsetzung des Strafmaßes als erschwerend berücksichtigt werden muss.

Consent refers to voluntary agreement as the result of a person’s free will. According to the Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence, the intimacy and trust connected with the relationship makes rape between such current or former intimate partners an aggravating circumstance that must be considered in the determination of the sentence.

- Comment Le fait de contraindre un conjoint ou ex-conjoint, ou un partenaire ancien ou actuel, à se livrer à des actes à caractère sexuel non consentis avec une tierce personne est également considéré comme un viol marital. On entend par consentement l'accord volontaire d'une personne, et de son plein gré . Conformément à la Convention du Conseil de l’Europe sur la prévention et la lutte contre la violence à l’égard des femmes et la violence domestique, l'intimité et la relation deconfiance relative à la relation font du viol entre ces partenaires actuels ou anciens une circonstance aggravante qui doit être prise en compte dans la détermination de la peine.
