- Comment 1) Protocol No 26 to the TFEU concerns SGIs, but does not define the concept. The Commission has clarified the concept in its Quality Framework. The term covers both economic activities and non-economic services.2) In some countries, the term “public services is used to describe these services. Although this is easier to understand, as the terms covers the main services that have traditionally been provided as part of the welfare state, it is now rather a misleading term. This is because in the majority of member states the state is no longer the sole provider of these services. The public authority can choose to deliver the services through a variety of different providers: public, private, NGO’s or third sector, or a mixture (public/private partnerships). The debate over “services of general interest” arises precisely because of the tension over how far the market involvement in the provision of basic services through the private sector (privatization and liberalization), needs to be ‘regulated and controlled” to ensure that the “public interest” is guaranteed, rather than ruled by the drive for profit.
